Donation & Gift Acceptance Policy

1. Purpose
This Donation & Gift Acceptance Policy outlines the principles and procedures by which Flat Rock Dam Coalition, Inc., a 501(c)(3) nonprofit organization based in the State of Michigan, accepts, acknowledges, and manages charitable contributions in compliance with federal and state regulations, including the Internal Revenue Code and the Michigan Charitable Organizations and Solicitations Act.
The policy is designed to ensure transparency, maintain donor trust, and promote legal and ethical fundraising practices.
2. Eligibility to Give
Flat Rock Dam Coalition, Inc. may accept contributions from:
- Individuals
- Businesses
- Foundations
- Estates and trusts
- Government agencies
- Other 501(c)(3) organizations
We DO NOT accept any donations or contributions maintained as Donor-Advised Funds (DAFs). For more information, please read IRS Publication 557.
All donations must be consistent with the mission and values of the organization. We reserve the right to decline any gift that is inconsistent with our mission, carries unacceptable restrictions, or could damage our reputation or independence.
3. Charitable Status and Tax Deductibility
Flat Rock Dam Coalition, Inc. is a federally recognized 501(c)(3) (pending) nonprofit organization (EIN: 39-2128172). Donations are tax-deductible to the fullest extent allowed by law.
- Donors will receive a receipt for any contribution of $250 or more, in accordance with IRS Publication 1771.
- Contributions of goods or services will be acknowledged but the donor is responsible for determining the fair market value for tax purposes.
4. Types of Acceptable Donations
We gratefully accept the following types of gifts:
- Cash/Checks: Payable to “Flat Rock Dam Coalition, Inc.”
- Online Donations: Via approved third-party platforms such as PayPal or Stripe
- Recurring Monthly Gifts
- Securities (Stocks and Bonds): Must be marketable and transferred to our brokerage account
- Bequests: As designated in wills or estate plans
- In-kind Donations: Must be pre-approved and useful to the organization’s operations
- Matching Gifts: Through employer or foundation programs
We do not accept:
- Gifts with illegal or unethical conditions
- Gifts of property or securities with complex restrictions
- Anonymous gifts of $10,000 or more without board review
- Contributions or donations to be maintained as Donor Advised Funds (DAF).
5. Use of Donations
All donations are used to support the charitable programs, advocacy, communications, events, and operations that further our mission to protect and preserve the Flat Rock Dam and the surrounding community.
Unless otherwise designated by the donor, all gifts are considered unrestricted and may be allocated to areas of greatest need as determined by the Board of Directors.
Designated Gifts must be:
- Clearly labeled with their intended purpose
- Used only for purposes consistent with our mission
- Subject to redirection with donor consent if the original purpose is no longer viable
6. Refund Policy
Flat Rock Dam Coalition, Inc. honors refund requests made within 30 days of donation if:
- The donation was made in error
- The donation was unauthorized or fraudulent
- The donor changes their intent within the allowable period

7. Donor Privacy
We respect the privacy of our donors and commit to the following:
- We do not sell, rent, or trade donor information.
- Donor names may be listed in public acknowledgments unless anonymity is requested.
- Donors may opt out of all communications or be excluded from public recognition at any time.

8. Legal Compliance
This policy complies with:
- IRS rules for charitable deductions
- Michigan Nonprofit Corporation Act (Act 162 of 1982)
- Michigan Charitable Organizations and Solicitations Act (MCL 400.271 – 400.294)
Flat Rock Dam Coalition, Inc. is registered with the Michigan Attorney General’s Charitable Trust Section and files all required annual financial reports.
9. Donor Acknowledgment & Recordkeeping
We acknowledge all donations with a timely receipt that includes:
- Organization name
- Date and amount of contribution
- Tax-deductibility statement
- Description of non-cash gifts (if applicable)
Donor records are retained securely in accordance with IRS and state retention rules (minimum 7 years for contributions over $250).
